GENERAL TERMS AND CONDITIONS

1. SCOPE

These General Terms and Conditions (GTC) apply to all orders placed through our online shop. These terms also apply to future business relationships with entrepreneurs, without the need for an explicit declaration. We do not recognize the effectiveness of conflicting or supplementary General Terms and Conditions from an entrepreneur unless we have expressly agreed otherwise.

2. CONTRACT PARTNER, CONCLUSION OF CONTRACT, CORRECTION OPTIONS

The contract is concluded with BEAUTY STEPS GmbH. By listing the products in the online shop, we make a binding offer to conclude a contract for the goods. You can place our products in the shopping cart non-bindingly and change your entries at any time before submitting your binding order by using the correction options provided and explained during the ordering process. By clicking the order button, the contract is concluded, and you accept our offer for the goods contained in the shopping cart. Once you have submitted your order, you will immediately receive a confirmation via email.

3. LANGUAGE OF THE CONTRACT, STORAGE OF THE CONTRACT TEXT

The available language(s) for concluding the contract: German, English. We store the contract text and provide you with the order details and our General Terms and Conditions (AGB) on a durable medium. You can also view the contract text in our customer login area.

All orders are delivered with DHL. Please ensure that the billing and shipping address details are correct when placing your order, as we cannot forward shipments. Please note that your billing address must match the address on your credit card statement.

Once your order has been shipped, you will receive a confirmation email. Before we can dispatch your purchases, we may need to verify your details with your card issuer. We will do our best to minimize delays.

4. DELIVERY TIMES

Delivery times are estimates and start from the shipping date. We strive to deliver your order as quickly as possible but cannot be held responsible for delays caused by the carrier (due to remote delivery locations, adverse weather conditions, etc.).

During the sale season, there may be slight delays with your order. Please allow up to 7 business days for your order to reach you.

We ship Monday through Friday, excluding holidays.

We deliver within Germany to Packstations.

INTERNATIONAL SHIPPING

We have partnered with DHL, allowing us to ship orders from clione-fit.de to over 190 countries. Delivery times, costs, and duties depend on your shipping location and will be displayed at checkout.

Products classified as hazardous materials can only be shipped abroad with limitations.

5. PAYMENT

The following payment methods are generally available in our online store:

CREDIT CARD

During the ordering process, you will enter your credit card details. Your card will be charged immediately after your order.

PAYPAL

To pay the invoice amount through the payment service provider PayPal (Europe) S.à r.l. et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself, enter your login details, and confirm the payment instruction. The payment transaction will be processed through PayPal after placing the order. Further instructions will be provided during the ordering process.

PayPal may offer additional payment options to registered PayPal customers based on its own criteria. We have no influence over these offers. Additional payment options offered individually affect your legal relationship with PayPal. For more information, please refer to your PayPal account.

AMAZON PAY

The invoice amount will be paid through the payment service provider Amazon Payments Europe SCA, 38 avenue J.F. Kennedy, L-1855 Luxembourg (“Amazon”). You must be registered with Amazon, authenticate yourself with your login details, and confirm the payment instruction. The payment transaction will be processed within one business day after placing the order. A business day is any weekday except Saturdays, national holidays, and December 24 and 31 of each year. Further information will be provided during the ordering process.

6. RIGHT OF WITHDRAWAL

Withdrawal Information for Consumers

According to § 13 BGB, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their self-employed professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without providing any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

To exercise your right of withdrawal, you must inform us (Beauty Steps GmbH, Kaiser-Friedrich-Promenade 85, 61348 Bad Homburg v.d.H., info@clione-fit.de, Germany, Phone: +49 (0)157 30222606) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email).

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you (excluding additional costs for the return resulting from you not collecting the delivery or refusing delivery) immediately and at the latest within fourteen days from the day we receive the goods back or until you provide proof that you have returned the goods, whichever is earlier.

For this reimbursement, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise; in any case, you will not incur any fees for this reimbursement.

We may withhold the reimbursement until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is earlier.

You must return the goods to us immediately and in any event no later than fourteen days from the day you inform us of the withdrawal from this contract, at your own cost. The deadline is met if you send the goods before the period of fourteen days has expired.

You are only liable for any diminished value of the goods if this loss in value is due to handling the goods in a way not necessary to ascertain their nature, characteristics, and functioning.

Please note: A 100% refund can only be granted if the items arrive with us in their original packaging and unused. For used items, we reserve the right to withhold part of the refund amount. Returns of vouchers and e-vouchers are excluded.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

  • For the delivery of goods that are not pre-manufactured and for which the consumer's individual selection or specification is decisive for their manufacture or which are clearly tailored to the personal needs of the consumer.
  • For the delivery of goods that may quickly spoil or whose expiration date would quickly be exceeded.
  • For the delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons if their seal was removed after delivery.
  • For the delivery of goods if these have become inseparably mixed with other goods due to their nature after delivery.
  • For the delivery of fragrance samples.

7. RETENTION OF TITLE

The goods remain our property until full payment is received.

For entrepreneurs, the following also applies: We retain ownership of the goods until all claims arising from an ongoing business relationship are fully settled. The resale of the goods subject to retention of title is permitted in the ordinary course of business. The claims arising from the resale, regardless of whether the retained goods are combined or mixed with a new item, are assigned to us in advance up to the amount of the invoice. We accept this assignment. You remain authorized to collect these claims; however, we also have the right to collect the claims ourselves if you fail to meet your payment obligations. Upon your request, we will release the securities to the extent that their realizable value exceeds the value of the outstanding claims by more than 10%.

8. DAMAGE DURING DELIVERY

For consumers: If the goods are delivered with visible damage that occurred during delivery, please report the damage immediately to the carrier and notify us without delay. Failure to make a complaint or contact us will not affect your statutory rights or the enforcement of these rights, especially your warranty rights. However, you will help us to assert our own claims against the carrier or transport insurer.

For businesses: The risk of accidental loss or deterioration of the goods passes to you as soon as we have handed the goods over to the carrier, freight forwarder, or other contractor for delivery to the person or institution you specified.

9. LEGAL WARRANTY

For all products purchased in our online shop, the statutory warranty according to the provisions of the German Civil Code (BGB) applies. The warranty period is 24 months from receipt of the goods. Within this period, you have the right to claim for rectification (repair or replacement) for defects that were present at the time of risk transfer. If the defects cannot be remedied through rectification, you are entitled to reduce the purchase price or withdraw from the purchase contract. Claims beyond this, especially for damages, remain unaffected, provided that the legal requirements for such claims are met.

To assert warranty claims, proof of purchase is required, which can also be provided in the form of a receipt, order confirmation, or delivery note for online purchases. Your statutory rights are not limited by any additional warranty granted.

10. LIABILITY FOR DEFECTS

We are legally obligated to deliver products that conform to this contract. Unless explicitly agreed otherwise, the statutory warranty provisions (liability for defects) apply. For consumers, the statutory warranty provisions of the country in which they have their usual residence apply.

The following limitations and reductions in deadlines for entrepreneurs/commercial parties do not apply to claims for damages caused by us:

  • in case of injury to life, body, or health
  • in case of intentional or grossly negligent breach of duty as well as fraud
  • in case of breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on which the contracting partner is regularly entitled to rely (cardinal duties)
  • within the scope of a voluntary guarantee, if agreed upon, or
  • within the scope of the Product Liability Act.

11. WARRANTIES AND CUSTOMER SERVICE

Information on any applicable additional warranties and their specific conditions can be found with each product and on special information pages in the online shop.

12. LIABILITY

For claims for damages caused by us, our legal representatives, or vicarious agents, we are liable in any case without limitation:

  • For injury to life, body, or health
  • In cases of intentional or grossly negligent breach of duty
  • For warranty obligations, if agreed upon
  • Towards consumers.

Except in these cases, our civil liability is limited to the foreseeable and direct damage at the time of contract conclusion.

13. PROTECTION OF PERSONAL DATA

The data controller is the seller.

As far as legally permissible, the recipient of the data may be a company providing services for the seller in connection with their activities, such as an execution contractor, a payment system operator handling the payment method chosen by the customer, a provider of postal or courier services, an after-sales survey operator that the customer may wish to complete, or a provider of office, accounting, marketing, or legal services.

If the basis for data processing is consent, the data subject has the right to withdraw their consent to the processing of personal data at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

In situations provided by law, the data subject has the right to request information from the seller about their personal data, correction, deletion, or restriction of processing, as well as the right to data portability and the right to lodge a complaint with the supervisory authority.

Requests regarding data processing should be directed in writing to the seller or via email to the Customer Service Office.

14. EXTRAJUDICIAL COMPLAINTS AND REMEDY PROCEDURES
(for consumers)

Consumers can use extrajudicial means to handle complaints and remedies.

Consumers may contact the competent provincial inspector of the trade inspection with a request to initiate a mediation procedure for the amicable settlement of disputes between the consumer and the seller in accordance with Article 36 of the Act of December 15, 2000, on Trade Inspection (Journal of Laws of 2001, No. 4, item 25, as amended).

Consumers may also resolve disputes arising from the concluded purchase contract through a permanent consumer arbitration court at the regional trade inspection inspector in accordance with Article 37 of the Trade Inspection Act.

Detailed information about extrajudicial procedures for handling complaints and remedies is also available at the offices and on the websites of the district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, and the Voivodeship Trade Inspection.

15. FINAL PROVISIONS
The raffle is subject to German law. Legal recourse is excluded.
